Procurement of annual maintenance services for the City of Bihać's asset management software, including the annual rental of infrastructure.
The Mayor of the City of Bihać has issued Decision No. 02/3-11-772-1/26 on initiating the public procurement procedure for the annual maintenance of the City of Bihać's asset management software, including the annual leasing of infrastructure. Article 21, paragraph (1), point c) of the Law on Public Procurement ("Official Gazette of BiH", no. 39/14, 59/22 and 50/24), provides that Contracting Authorities may award contracts through a negotiated procedure without a prior notice of contract when, for essential, demonstrable technical or artistic reasons, or for reasons relating to the protection of exclusive rights, the contract can only be awarded to a particular supplier. The company "GAUSS" d.o.o. Tuzla, as a legal entity, is the author and therefore the owner of the programme and holds the exclusive right to the annual maintenance of the city of Bihać's asset management software, including the annual leasing of the infrastructure, which is used by the contracting authority.

Gradonačelnik Grada Bihaća je donio odluku broj: 02/3-11-772-1/26 o pokretanju postupka javne nabavke usluga usluge godišnjeg održavanja softvera za upravljanje imovinom grada Bihaća sa uključenim godišnjim iznajmljivanjem infrastrukture. Članom 21. stav (1) tačka c) Zakona o javnim nabavkama („Službeni glasnik BiH“, broj 39/14, 59/22 i 50/24), propisano je da Ugovorni organi mogu ugovore dodjeljivati putem pregovaračkog postupka bez objave obavještenja o nabavci, kada se iz suštinskih, dokazivih tehničkih ili umjetničkih razloga, ili iz razloga koji se odnose na zaštitu ekskluzivnih prava, ugovor može dodijeliti samo određenom dobavljaču. Firma „GAUSS“ d.o.o. Tuzla, je kao pravno lice, autor i prema tome i vlasnik programa i ima ekskluzivno pravo godišnjeg održavanja softvera za upravljanje imovinom grada Bihaća sa uključenim godišnjim iznajmljivanjem infrastrukture, a kojeg koristi ugovorni organ.
